The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.

Jurisdiction

This agreement and this website are subject to the laws of NSW and Australia. If there is a dispute between you and Cosmetic Medical Clinic (NSW) Pty Ltd that results in litigation then you must submit to the jurisdiction of the courts of NSW.

Treatments and Services

All treatments and services offered are required to be prepaid. Treatments are non-transferable to other individuals, and treatment packages are not available to be split between different persons.

Clinicians at Cosmetic Medical Clinic reserve the right to determine the suitable treatment for the client, and to refuse the administration of any treatment if deemed not suitable. 

As all services are prepaid, 100% of the treatment cost is needed to be settled before the commencement of a treatment. In the case of treatment packages, this will have to be paid before the start of the first treatment session.

Consultations

An initial in-person consultation is required before booking any treatment. This is to ensure the suitability and appropriateness of a treatment/procedure in addressing your skin concern.

A holding deposit of $80 is required to be paid at the time of booking the consultation.

This policy outlines the terms for booking, rescheduling, and cancelling appointments at Cosmetic Medical Clinic (CMC). All clients are encouraged to review these terms before making a booking.

This policy applies to all appointment types, including consultations, treatments, and follow-ups. CMC reserves the right to update this policy without prior notice to reflect operational or regulatory requirements.

Booking Consultations

An $80 booking fee is required at the time of booking a consultation. All booking fees are non-refundable.

If you book a treatment within seven (7) business days after your consultation, the fee will be credited towards your treatment cost.

If no treatment is booked within seven (7) business days, the fee will be retained as an administration fee and cannot be credited towards future treatments.

Booking Treatment Appointments

A 50% deposit of your quoted treatment cost is required at the time of booking treatment to secure your appointment booking. All deposits are non-refundable.

Appointment confirmation will be sent to your nominated email address after booking. It is the client’s responsibility to ensure they have received and checked this confirmation. Please review all appointment details carefully, as CMC will not be liable for any missed or overlooked appointments.

An SMS reminder may be sent prior to your appointment; however, this message is provided as a courtesy reminder only. All appointment confirmations are made by email.

Late for Appointment

If you arrive more than 15 minutes late, your appointment may be treated as a same-day cancellation to avoid disruption to other clients.

Service time cannot be extended for late arrivals and may affect the completion of your treatment.

Rescheduling Appointments

Rescheduling any appointment requires at least two (2) business days’ notice, provided by telephone or email during business hours.

Rescheduling within two (2) business days may result in forfeiture of the holding deposit or require a new deposit to secure another booking.

Cancelling Appointments

Cancelling any appointment requires at least two (2) business days’ notice, provided by telephone or email during business hours.

If notice is given before or within two (2) business days, the holding deposit may be credited to your client account for future use.

Same-day cancellations will result in forfeiture of payments and/or deposits paid.

All payments and deposits are non-refundable.

Failure to Attend / No Show

Your payments and/or deposits will be forfeited if you fail to attend your appointment (also known as ‘no show’) or if you cancel on the same day as your appointment.

Our refund policy applies to all transactions made online through our website, over the phone, and within the clinic premises.

• All payments and holding deposits are non-refundable.
• Cosmetic Medical Clinic does not provide refunds for “Change of Mind” purposes.
• Failure to attend a booked appointment, same-day cancellation and/or rescheduling of appointments for treatment within two (2) business days of the appointment time, will result in the whole of any payments or holding deposits being forfeited to the account of CMC. These conditions are at the discretion of CMC, and depending on circumstances, exemptions may be granted.

Use of Heidi Health AI for Clinical Documentation

Cosmetic Medical Clinic (NSW) Pty Ltd uses Heidi Health AI, a secure, Australian-based clinical documentation platform, to assist with accurate recordkeeping of consultations, follow-up appointments, and treatment notes.

During some appointments, audio may be recorded and automatically transcribed into clinical notes within Heidi Health’s encrypted system. These records are used solely for clinical and administrative purposes, such as maintaining accurate patient records and supporting continuity of care.

Patients are informed prior to recording, and recordings are only made with patient awareness and consent. The data is stored in accordance with Australian Privacy Principles (APP 6 & 11) and Heidi Health’s security framework. No data is shared with external parties for marketing or non-clinical use.

3. How We Use Your Information

    •    To provide medical and cosmetic treatment and manage your patient record;

    •    To schedule appointments and manage payments;

    •    To comply with legal and regulatory obligations;

    •    To communicate with you about your care, updates, or clinic information.

4. Disclosure of Information

We may share information with:

    •    Our treating medical practitioners and authorised staff;

    •    Service providers assisting with billing, IT, or record management;

    •    Regulatory authorities when required by law.

We do not sell or disclose your information to third parties for marketing purposes.

5. Data Security

Personal information is stored securely in electronic medical record systems (including Zanda Health) with access restricted to authorised personnel. We take reasonable steps to protect your data from unauthorised access, alteration, or loss.
